a. 'Referrer' or 'you' means a person of 18 years or above, who has completed or is participating in any Scaler Program, and who is referring a Referee, provided that if such person is employed or engaged by Scaler for any work, s/he will not be considered a Referrer under this policy.
b. 'Referee' means the individual who is a friend, relative or connection, of the Referrer, being referred by a Referrer.
c. 'Referral Code' is the code generated by the referrer on the Scaler Platform.
d. 'Referral Policy' means the Scaler Refer and Earn T&C’s.
e. 'Referral Reward' means the benefit available under this program, in the form of cash, vouchers, goodies, scaler coins, or fee waivers as the case may be, for a Qualified Referral.
f. 'Cohort' or 'Batch' defines the month in which the referee/friend has commenced their learning program
g. 'Enrolled Referral': Once a person registers on the Platform as a Learner and purchases a subscription to a Program using your Referral Code, such person shall be considered as your “Enrolled Referral”, subject to the terms herein.
h. 'Program' means the Scaler Academy Program, Scaler Data Science and Machine Learning Program in India or USA, or the Dev Ops Program.
i. 'Platform' means scaler.com, other platform (including chat groups, Scaler hosted social media forums/pages and webpages) which may allow you to access and/or use the services offered by Scaler (for working professionals) via any other device/medium.
j. 'Qualified Referral' means a person treated as an Enrolled Referral, and whose reachable mobile phone number is validly shared (with the Referee’s consent) by the Referrer, that uses the Referral Code of a Referee (in accordance with our Terms and conditions).
k. 'SET' means the Scaler entrance test required to be written for the purpose of batch allocation and admission in the Program.
The Referrer must share their referral code allotted to them by Scaler ('Referral Code') with the Referee, which in turn must be used/applied by them in their application process at Scaler for enrolment to a Program. Alternatively the Referrer, (i) will share the referral code with a designated referral manager appointed by Scaler, who will apply the Referral Code on behalf of the Referee; or (ii) Fill out the Referee’s details (provided that such referral is made in accordance with this policy) on scaler.com/invite-friends. The timestamp at which the code is either (a) entered by the Referee, (b) shared with referral manager, or (c) filled out by the Referrer on scaler.com/invite-friends, (or the earliest of (a),(b), or (c), if the code has been used more than once in respect of the same ) will be considered as the timestamp for referral. Sharing a referral code with a counsellor will not count as a valid referral, and the counsellor cannot apply for a referral on behalf of a Referrer/Referee. The Referral will only be valid if a Referee enrols and makes a payment of fees to Scaler, within 2 months from the date recorded as the timestamp for referral. For the avoidance of doubt, a referral code can’t be applied in a manner after enrollment at any point. A person will be deemed to be ‘enrolled’ if he pays any blocking amount, or makes a downpayment/ full payment for a Program.
Lead Clash: If a Referee has been referred to Scaler by more than one person by any of the above ‘ways to refer’, a call/email-based confirmation will be taken from the Referee for them to select their Referrer. Rewards for any case where we have not been able to receive confirmation from a referee over call/email will be kept on hold until confirmation. The Referee’s choice once captured on call/email cannot be changed/modified.
A. For the Programs: The reward receivables, for referrals, shall be determined on the basis of the cohort in which the Referee has registered and paid for Scaler. For cohorts commencing after August 1, 2024 the quantum of rewards may differ based on whether the referral code is entered in our systems (as per clause 2 above) on or prior to writing the SET, or after i.e. Post-SET, based on the timestamp of the referral. If a referee has attempted the SET multiple times, the first ever SET attempt will be considered as the timestamp of the test attempt for determining the quantum of (Pre-SET or Post-SET) rewards.
However, Scaler will be entitled to grant rewards only for Qualified Referrals, who are working professionals with at least 6 months of experience. Further, in the event that a Referrer has made more than 15 referrals in a single Cohort, such Referrer will only be entitled to rewards worth INR 5000 per Qualified referral, in respect of those referrals exceeding 15. In such a case, while computing the rewards payable for the first 15 referrals in a Cohort, priority will be given to pre-SET referrals over post-SET referrals. For instance if someone has 12 pre-SET and 7 post-SET Qualified Referrals, only the reward 4 post-SET Qualified referrals (exceeding 15 referrals) will be payable at the lower rate of INR 5000.
- The rewards structure is subject to change for every Cohort. For example, If the Referee has joined the October Batch, the reward structure applicable only for that cohort will be considered. If the Referee joins the November Batch, the reward structure applicable only for that cohort will be considered. The latest reward structure will be available on the website.
- The Referee’s reward, for an Enrolled Referral shall be a fee waiver on the Program fees (of such amount as may be determined by Scaler from time to time), which shall be applied to the balance payment stage, provided that if the Referee opts for a 24 month EMI payment schedule with a financing partner, then s/he will not be entitled to such a waiver. The Referee’s rewards is subject to change for every cohort, at Scaler’s sole discretion.
- Referral rewards will only be payable for Qualified Referrals, and will be subject to applicable taxes(including but not limited to TDS). The Referrer must fill and submit the form sent over mail, to Referral team, to choose and receive the Rewards.
- As per the new Section, 206 AB inserted in the Income Tax Act by the Finance Act 2021, if you are a 'specified person' as prescribed under section 206AB, the tax deducted at source for all Referral Rewards shall be at - (a) 5% or (b) twice the rate applicable to referral fees; whichever is higher,.
'specified person' means a person who has not filed the returns of income for both of the two assessment years relevant to the two previous years immediately prior to the previous year in which tax is required to be deducted, for which the time limit of filing return of income under sub-section (1) of section 139 has expired; and the aggregate of tax deducted at source and tax collected at source in his case is rupees fifty thousand or more in each of these two previous years The Income tax department has facilitated a link where businesses can check if any person is a
'specified person' and thereby deduct the relevant taxes to comply with the provisions of Section 206 AB.
We will track the Enrolled Referrals generated by you through your Referral Code, and we will make this information available to you either on your dashboard on the Platform or otherwise communicate to you (including via email). Please note that Referral Codes are unique to each person, and only when the person clicks on the invite link and/or uses the Referral Code, before subscribing to a Program by Scaler, will he/she/they be considered as your Enrolled Referral. In other words, if the person you referred has failed to use the invite link and enter/apply the Referral Code that is unique to you while purchasing a Subscription (as applicable) on the Platform, then such person shall not be considered as your Enrolled Referral, and you shall not be eligible to receive any Referral Rewards (defined below) in respect of that person. Similarly, any failure on your part to display or share the correct Referral Code shall not be the responsibility of Scaler. Therefore, to permit accurate tracking, reporting, and commission accrual, you must ensure that the Referral Codes are properly made available to your referrals.
The Referrer must refrain from sharing his or her code with any employee at Scaler or any entity associated with the direct sale of any of Scaler’s Programs for the purpose of getting the Referral Code used by Scaler’s prospective learners who the Referrer has no connection with. Violation of the foregoing will result in a detailed evaluation, basis which Scaler will have the right to deactivate your Referral Code and forfeit any future payments
A Referrer is required to share only their relevant payment details as prescribed by Scaler in order to receive Referral Rewards, and not any business/friend/relative’s/other account. A Referrer will be eligible to receive Referral Rewards only if they have completed their payment formalities and not opted for a refund of course fees in respect of any Program subscribed to by the Referrer himself/herself. In the event that a Referrer has shared incorrect bank account or email ID/address details with Scaler, then any Referral Rewards paid to such incorrect account, email ID or address will not be reprocessed. Any Physical goodies are subject to availability (choice of colour of the physical goodie is not provided). In case a particular goodie is not available, an option to select an e-voucher will be provided. E-vouchers cannot be converted in cash and must be used before their expiry date (expired e-vouchers will not be reissued). Scaler coins may be granted for referrals, even if the referral is not an Enrolled Referral, at Scaler’s discretion, provided that they will be capped at 2500 scaler coins per cohort, and such coins can only be redeemed at the Scaler store.
Any queries or claims relating to determination of awards or being qualified for such awards must be raised within 3 months from the date the Referee uses your invite link and/or Referral Code. If rewards (including cash/goodies) are
‘unclaimed’ for a period of 3 months from their grant, they will expire and no replacement rewards will be provided. Rewards will be deemed to be unclaimed (i) if payments cannot be processed due to incorrect/unavailable bank details, or incorrect/unavailable/inoperative PAN; (ii) if a preference for a goodie is not shared over email, upon a request from Scaler.
If any additional payment or reward is incorrectly made to a referrer, and Scaler has the right to recover the same by way of set-off against future payments.
You shall communicate clearly that you, not Scaler, are the sender of all marketing communications related to the promotion of Scaler’s Services
All User Data that you create, transmit, transfer to us, submit, display or otherwise make available while using the Scaler Services, should only be information that you own or have the right to use or share (as may be applicable). If you transfer any personal information to us , we will assume that you have informed the person concerned and procured the necessary consent for such transfer, sharing, processing and/or using the information on the Platform and/or in respect of the Services. We may use the above information as per our Privacy Policy, terms and conditions, and in accordance with applicable laws.
While we make commercially reasonable efforts to ensure that the data stored on our servers is persistent and always available to our Users, we will not be responsible in the event of failure of the third-party servers or any other factors outside our reasonable control, that may cause the User Data to be permanently deleted, irretrievable, or temporarily inaccessible.
- Referrals made to any persons (i) already registered on the Platform, (ii) persons eligible for Programs who have attended a masterclass with Scaler or have registered to attend one; (iii) are a member of any social media/messaging group run by Scaler, shall not be deemed as Qualified Referrals.
- If a Referee referred by Referrer initiates cancellation or refund of the subscription/course fee on the Platform within 30 (thirty) days of the start of course instruction, or such other number of days as mentioned on the Platform, whichever is greater ('Trial Period') from the date of purchase of the Subscription on the Platform, or if there have been any chargebacks by such Referee, then such person shall not be deemed as a Qualified Referral, and the Referrer shall not be entitled to any Referral Rewards in respect of such person.
- No referral shall be considered as a Qualified Referral, if Scaler suspects any fraudulent activity by the Referrer to increase Qualified Referrals, including without limitation, the use of any software that generates real and fictitious information, multiple accounts from the same users referred by you, or any activity that does not comply with the Referral Terms and/or https://www.scaler.com/terms/. In these cases, Scaler shall also have the right to terminate the Referrer’s access to the referral program, at its sole discretion.
- Where any Referee, receives or was offered coupons, refunds, credits or discounts by the Referrer to purchase a subscription on the Platform and such offering was a not authorised by Scaler, then such purchase by the Referee shall not amount to a Qualified Referral.
- If it is found by Scaler that a Referrer has adopted marketing practices in contravention to these Referral Terms or that we deem to be unethical or are likely to attract fraudulent signups, then Referees referred by the Referrer shall not be deemed a Qualified Referral.
- Any referral that is deemed to be in contravention of these Referral Terms, Platform Terms and/or any other terms as communicated to the Referrer by Scaler in writing (emails included) at the sole discretion of Scaler, shall not be deemed as a Qualified Referral.
- Referral invitation links with valid content about Scaler/upskilling posted on social media may not be considered towards referral benefit. However, the final eligibility decision lies with Scaler subjected to post successful verification.
- The Referral Code usage shall be evaluated on a case-to-case basis by Scaler and Scaler holds the power to block the Referral Code if any misuse is suspected, at the sole discretion of Scaler. The decision of Scaler will be final in this case.
- Any Referral made in contravention of the terms of paragraph 4 above, including but not limited to, cold calling or contacting Referees who are part of telegram groups, without their consent.
- Any Referral made without any communication between the Referee and the Referrer. If a Referee is unable to identify the Referrer, and the Referrer is unable to provide proof of any conversation, then the Enrolled Referral will not be treated as a Qualified Referral.
- If a Referee does not enrols and make a payment of fees to Scaler, within 2 months from the date recorded as the timestamp for referral.
- You shall bear your own costs and expenses related to marketing and promoting Scaler. Scaler is not obligated to reimburse or credit you for any marketing expenses, unless it has been specifically agreed by Scaler in writing (emails included).
- You hereby represent and warrant that your marketing practices do not violate any of the following restrictions. you shall -
- not advertise Scaler as a free product.
- not make any false, misleading, or disparaging statements with respect to the Scaler, its employees, its customers, its affiliates, its Services, or the Referral Program.
- not use traffic that is generated by, including, but not limited to, pay to click, pay to read, banner exchanges, click exchanges, cost-per-view advertising, pop-up/under, spam, purchased traffic, or similar methods without prior written consent from Scaler.
- not create websites or advertisements that copy, imitate, or resemble the look and feel of Scaler’s Services.
- not engage in the advertisement of business-opportunity websites or use marketing practices that attract fraudulent or short-term customers.
- not engage in any marketing activity that may harm the reputation or credibility of Scaler, including but not limited to using low-quality marketing materials, or advertising on any website that promotes violence, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or any illegal activities, or violates the intellectual property or other rights of a third party.
- communicate clearly that they, not Scaler, are the sender of all marketing communications related to the promotion of Scaler’s Services as part of the Referral Program.
- not market using bulk broadcast/telemarketing/text message/email marketing or any other mass communication method, including posting using the Scaler name or trademark without the express written consent of Scaler, and posting invite links and Referral Codes without the consent of Scaler.
Any breach of the above representations and warranties, will result in the referral not being treated as a Qualified Referral.
- Scaler’s Referral Policy has been designed with the intention to make education a cost-effective option for the friends/colleagues/connections and family members of our ever-growing student community.
- The Referral Code usage shall be evaluated on a case-to-case basis by Scaler. If misuse of a referral code is suspected, Scaler has the right to deem the referral null and void. The decision of Scaler will be final in this case.
- Referral Rewards are non-transferable; non-endorsable; non- exchangeable for equivalent amount of money or anything of value. Scaler does not promise/promote to do the same.
- To validate fair usage, Scaler may conduct a simple call-based verification process to understand the connection between the referrer and referee.
- The referral code once entered by the referee and who has enrolled with Scaler, cannot be modified/changed. If the referral code once entered by a referee is incorrect, the policy remains the same and the final decision lies with Scaler. Nothing contained herein will create a relationship of employment or other similar contractual relationship between Scaler and the Referee.
- If it is found that a Referrer is influencing a Referee to use their referral code, by offering them money/part of their Rewards, this can lead to deactivation of Referral Code.
- Alumni sharing alum connect leads (i.e. leads referred by Scaler to a Scaler Program alumni), as Referrals will not treated as Qualified Referrals.
- In the event of any breach of the terms of this Referral Policy (which will include making or attempting to make any Enrolled Referrals that are not Qualified Referrals, except where the Referee opts for a refund within the Trial Period) by a Referrer, Scaler has the right to cancel your Referral Code and ban you from participating in the Referral Policy.
